BAN ON SOFTDRINKS

                 We people are struggling a lot for water and fighting with other states for water. Soft drinks are also a reason for our water scarcity. The water that was available for agriculture has been utilized by these people for the process of generation of the cool drinks. Yes, we people made a huge mistake by supporting these drinks, which were harmful to us as well as to the farmers. There were plenty of water available for them to cultivation but now these companies extracted them and made them unavailable for agriculture.

                   We people have also encouraged them and slowly our Indian products have been destroyed and the good products like tender coconuts and fruit juices have been neglected. These would have been of lot of benefit to us as well as their cultivators. In most of the cases these fruits have either been rotten or sold to these corporate companies at cheaper prices. We are to be blamed. Once upon a time we depended on foreign investments to improve our economy. But, It was like putting sand on our own head. We have not bothered to come out from it.

                  Whatever happened is happened. Now, it is the last chance for us to wake up. We need not be looking out for the ban on these soft drinks. We must ensure that we wont use these products. when we start to reduce the consumption of these soft drinks. Our health will also be safe and the water which is the most need of the hour will also be conserved. So, it will also be a good idea to stop using soft drinks rather than expecting a ban on them considering doing some good deeds for the benefit of our future generation

WATER SCARCITY

                   I would like to insist on water scarcity. Water is one of the scare commodity that is available to man kind. A man can even live without food  for many days but not water. Water plays such a vital in a person's life. Not only for living, it is used for other items also. Water is necessity for irrigation, generation of electricity, cleaning, washing, bathing etc. It is also a commodity that cannot be owned by a single person or community or state. It is common for all. It is not good enough to enjoy the ownership of such commodities.

                  Yes, it is very much important to feed your people, but it is good enough to let others die and enjoy everything by yourself. We are not demanding the whole water, at least certain amount which will save us from dying. It is what we require from them. We are ready to help them in any kind of issues, but they are not even ready to help us in water. We think them as brothers or sisters but they think us as aliens. We never hit or injured the people from their state but they almost killed our people. The worst thing about this is no one is ready to support us in this issue.

                Everything is caused because of us. We people started to built apartments everywhere. So, in places where there were 100 houses got converted to 1000 houses due to this apartments and water consumption increased. That is part and parcel of life, but they are not considering to save the water. Many dont bother about the leakages in taps. They waste water by cleaning their cars and vehicles regularly. Even unused cars are being cleaned regularly. Recycling process is not being implemented, moreover the rain water is being wasted very much. Trees are the reason which help us get rainfall which is the main source of water.

              Even those trees are not spared, they are being cut for their wood and other useful products. If these things continue to happen, it is very difficult for us to survive. We all must join hands and preserve certain amount of water for people of the next few generations at least.

MY VIEWS ON JALLIKATTU

                Jallikattu is one of the games which is known as traditional sport of people of tamil nadu. It is followed as a custom and hails back to thousands of years. It is a sport of bull embracing and not bull fight. one thing, that we need to understand is , the sport has some problems. It is not good enough to ban the sport as a whole. There may be certain restrictions brought on the sport. The bull and its owners get sponsors by conducting the sport and it will help the poor farmers to grow their bulls and other cattle. If they fail to earn money, they would be pushed upon to sell out their cattle at a lower price and then the breed also might get extinct.

                Already the number of breed of cattles has been reduced to 35 and the total number of cattle which were lakhs in count has been reduced to few thousands. If these cattle also won't survive and the people who are affected are not only farmers but we common man also. The Artificial insemination process would be undergone . we could be made to make use of these artificial milk, that might result in lot of harmful side effects. Every sport has certain harmful features in it. If we consider that, then those sports also need to be banned. Certain sports can cause death to the people, these organizations are not worried about that.

               One more thing, there are various ways in which animals are being tortured but no association or club is ready to take action against that, is there is aim to really protect cruelty against animals or just to ban our sport alone . We will accept the sports to be conducted in safer manner and not ready to accept the ban.

SALOMON VS SOLOMON CASE

               This case was an interesting case I came across in one of the classes during my MBA lecture. The case mainly consisted of unsecured creditors in the liquidation process of Salomon limited. In this company Saloman was the major shareholder and hence he was made personally liable for his company's debt.Hence, the issue was whether, regardless of the separate legal identity of a company, a shareholder/controller could be held liable for its debt, over and above the capital contribution, so as to expose such member to unlimited personal liability.The Court of Appeal, declaring the company to be a myth, reasoned that Salomon had incorporated the company contrary to the true intent of the then Companies Act, 1862, and that the latter had conducted the business as an agent of Salomon, who should, therefore, be responsible for the debt incurred in the course of such agency.
            The House of Lords, however, upon appeal, reversed the above ruling, and unanimously held that, as the company was duly incorporated, it is an independent person with its rights and liabilities appropriate to itself,and that "the motives of those who took part in the promotion of the company are absolutely irrelevant in discussing what those rights and liabilities are".Thus, the legal fiction of "corporate veil" between the company and its owners/controllers was firmly created by the Salomon case. Commencing with the Salomon case, the rule of SLP has been followed as an uncompromising precedent in several subsequent cases like Macaura v Northern Assurance Co, Lee v Lee's.
              Air Farming Limited, and the Farrar case. The legal fiction of corporate veil, thus established, enunciates that a company has a legal personality separate and independent from the identity of its shareholders.Hence, any rights,obligations or liabilities of a company are discrete from those of its shareholders, where the latter are responsible only to the extent of their capital contributions, known as "limited liability".This corporate fiction was devised to enable groups of individuals to pursue an economic purpose as a single unit, without exposure to risks or liabilities in one's personal capacity. Accordingly, a company can own property, execute contracts, raise debt, make investments and assume other rights and obligations, independent of its members. Moreover, as companies can then sue and be sued on its own name, it facilitates legal course too. Lastly, the most striking consequence of SLP is that a company survives the death of its members.While the Salomon rule appears to have been eroded substantially, a reversal in the judiciary's approach, commencing with the Adams case, is now visible.
              For instance, in Bank of Tokyo v Karoon,the Court of Appeal rejected the "single economic unit" theory arguing that "we are concerned not with economics but with law. The distinction between the two is, in law, fundamental  and cannot here be abridged". Further, in the case of VTB Capital Plc v Nutritek International Corporation,the court reiterated the restricted scope of veil piercing as only a limited equitable remedy.On a similar note, in the most recent judgment of Prest v Petrodel, Sumption J. confined the lifting of veil to only two situations, namely, (a) the "concealment principle", akin to the sham or façade exception; and (b) the "evasion principle", being the fraud exception. Deciding not to pierce the corporate veil on the facts, this case once again reinstated the Salomon rule.
             All in all, the Salomon ruling remains predominant and continues to underpin English company law. While sham, façade and fraud primarily trigger the invocation of the veil piercing exception in limited circumstances, these grounds are not exhaustive, and much is left to the discretion and interpretation of the courts on case-to-case basis.

THE IPL MATCH WHICH I WITNESSED LIVE

                           I watched the IPL match between CSK and RCB which was held on 12th April 2012. Since, It has been so long. I dont remember the whole incident clearly and I am going to share the happenings which I remember. It was the 13th Match of 5th edition of IPL held at Chepauk Stadium in Chennai. The toss was won by Daniel Vettori who captained RCB in that match. It was worry for us being CSK supporters, but we beleived in CSK. Being a star Batting Line up, RCB launched very well, it was their Openers Mayank Agarwal and Chris Gayle who gave them splendid starts. They both were taking the bowlers to cleaners. It was Albie Morkel who took the wicket of Rising star Mayank Agarwal and gave the much needed breakthrough for CSK. But, It was Virat Kohli who accompanied Chris Gayle. It was a carnage of batting display from RCB.

                             CSK bowlers did not have clue to their batting. They both shared a partnership of 109 before Jadeja removing Chris gayle in the 17th over courtesy Bravo's brilliant catch. Bollinger Removed virat Kohli during his final assault. The score was reading 198 for 4 at the end of 19th over. We were expecting a score in excess of 210. Brilliant over from Bollinger produced 5 dot balls but Vinay Kumar did not give up and scored 6 of the last ball of the over and the final score of RCB was 205 for 8. CSK conceded as many as 16 extras of which 14 were wides. Though CSK is a good batting line up, it was an herculean task for them to beat the score. Moreover the had best and experienced bowling trio of Muralitharan, Zaheer Khan and Vettori.

                               Both the opening bowlers kept simple line and length and gave nothing away to the batsmen. The scoreboard was not moving on well, it was upto the batsmen to take risks and up the tempo. Murali Vijay got out in the process when he was on 11 and the team score read 56 in 6.5 overs. An excellent caught and bowl by Muralitharan. Suresh Raina joined with Faf Du plesis and gave some lusty blows, but that was not enough. He got out on 23 when the team score was reading 88 for 2 and 10.3 overs were completed. Faf was playing gem of an innings on one side but not getting proper support from other end. Captain MS Dhoni promoted himself up the order and decided to take on the bowlers on his own. Faf and Dhoni were going great guns until the effort from Muralitharan made him to do mistake and remove his wicket also.

                               CSK were very unfortunate for letting Muralitharan out of auction considering his age factor. But, his game showed that he is younger than many youngsters. He almost made the task impossible for CSKians. Bravo joined captain and something miraculous was required from both of them to chase down the target. The major drawback RCB had was 5th bowler and Vinay kumar's leak of runs. Raju Bhatkal was given the 5th bowler start but he leaked too many too early. So, the ball was given to Virat Kohli who gave away only 8 runs in his first over. Captain Dhoni was removed by Zaheer khan on 40 and the score reading 163 for 4 at the end of 18 overs. The crowd lost hope as 43 from 12 balls looked almost impossible and with their Dhoni being out, they started to leave. But, me and my friend still had a hope and decided to watch the match till the end.

                                One good thing was the dangerous trio finished their full quota of 4 overs and it was between Virat Kohli and Raju Bhatkal to bowl 19th over as vinay kumar was left with final over. This was a game changing over. Albie Morkel was on the strike. It was first ball of the over and the ball was given to Virat Kohli as he gave only 8 runs in the previous over he bowled. The first ball had inside edge and it run away to 4 without disturbing the stumps. Then it was 6,4,6. Wow, what a man Albie was. The runs needed reduced to 23 from 8. Again he went for a biggie but did not connect properly but he ran 2. The last ball was a huge six and the equation was reduced to 15 from last over and the gambling of bowling Kohli in the penultimate over cost them.

                               The last over had vinay kumar which gave just 1 run in the first ball and dismissed Albie in the second, wanting CSK to score 14 from 4. Jadeja joined Bravo. There was a noball, waist high full toss and bravo managed to find the fence making it 9 from 4. The very next ball was dispatched to a huge six by Bravo, making the equation 3 from 3. The next two balls was dot and single, leaving jadeja to score 2 from the last ball. He managed to edge a ball and find the fence, which made CSK win the match. It was the first match I witnessed in the stadium and what a thrilling encounter it was
